DataArt AI Assistant Terms of Use

DataArt (“DataArt,” “we,” “our,” or “us”) provides the functionality of the DataArt AI Assistant (“AI Assistant”) on this website (the “Site”) subject to the following terms and conditions (the “Terms”). We may periodically update these Terms, so please check back from time to time. By accessing and using this AI Site Assistant, you agree to these Terms.

1. Site Content and Use

All content and functionality on the Site, including text, graphics, logos, icons, and images and the selection and arrangement thereof (“Site Content”), is the exclusive property of DataArt, its affiliates, or its licensors and is protected by international copyright laws. The trademarks, service marks, designs, and logos (collectively, the "Trademarks") displayed on the Site are the registered and unregistered Trademarks of DataArt, its affiliates, and its licensors. All rights not expressly granted are reserved.

You may not reproduce, modify, distribute, transmit, post, or disclose the Site Content without DataArt’s prior written consent. Any unauthorized use may result in civil or criminal liability.

2. AI Assistant Terms and Conditions

2.1 Overview

The AI Assistant uses generative artificial intelligence technologies, to help provide responses to your business-related questions. These AI models are industry standard third-party systems that are not controlled, customized, or configured by DataArt.

Important: The AI Assistant works exclusively with DataArt Site Content. All responses are based on the Site’s pages and do not include external sources.

Use of the AI Assistant is optional. For business-related inquiries, you can also contact us directly via DataArt Contact Page.

Because responses are generated by artificial intelligence, they may occasionally be inaccurate, incomplete, biased or not fully aligned with DataArt’s views. They are provided for convenience only and should not be relied upon as the sole basis for critical decisions. If you encounter an issue, error or believe an output is inappropriate, please notify us at ai-feedback@dataart.com.

2.2 Acceptable and Prohibited Use

The AI Assistant is provided for non-commercial use and for legitimate business purposes only. By using the AI Assistant, you agree:

  • Not to use the AI Assistant to obtain information for any person or entity other than yourself.
  • Not to use responses for any purpose other than seeking answers to business-related questions.
  • Not to rely on the AI Assistant for professional advice (legal, financial, tax, investment, or otherwise).

You further agree not to use the AI Assistant for any illegal, harmful, or abusive activity, including:

  • Using the AI Assistant to engage in, promote, encourage, or facilitate any unlawful activity, including violations of local, national, or international laws or regulations
  • Violating infringing, or misappropriating intellectual property rights, privacy rights, proprietary rights, or any other legal rights of third parties.
  • Disrupting, testing, or attempting to bypass security without explicit authorization.

Do not provide personal or sensitive information to the AI Assistant. We maintain a record of prompts and responses for service improvement.

2.3 Privacy

AI Assistant is designed solely as a smart search tool to help users navigate and locate information on DataArt site. The AI Assistant is not intended to process personal data within user prompts, and we ask that you do not submit personal or sensitive information while interacting with it.

To enable continuity of your browsing experience, we temporarily process non‑personal session data (such as a session identifier and connected interaction history) for up to 12 hours. The session identifier is not processed afterwords and is not used for analytics, profiling, or training of the AI system.

If, during your interaction, you choose to use our “Contact Us” form, the history of your last 12 hours interaction with the AI Assistant will be attached to your inquiry to help us provide a more accurate response. In this case, your submission – along with any personal data you voluntarily provide – will be processed in accordance with our Privacy Policy.

We do not share session identifier with third parties, and we do not use personal data to train or improve the AI Assistant. Any personal information processed through the “Contact Us” form is handled strictly within our standard data protection practices and applicable legal requirements.

3. Intellectual Property Infringement

If you believe your intellectual property rights are infringed by any content on the Site, please contact us at ai-feedback@dataart.com, given a written statement that contains:

  • Identification of the copyrighted work or IP right claimed to have been infringed.
  • Identification of the allegedly infringing material on the Site.
  • Your contact details.
  • A statement of good faith belief and authorization.
  • Your signature.

4. Disclaimers

The Site and AI Assistant are provided “as is” and “as available”. DataArt makes no warranties of any kind, express or implied, including but not limited to any implied warranty of accuracy, completeness, merchantability or fitness for a particular purpose. DataArt shall not be liable for any indirect, exemplary, special, punitive, incidental, enhanced or consequential damages including loss of profits, anticipated profits, loss of business opportunities, goodwill or reputation arising out of or in connection with your use of the Site or AI Assistant.

5. Governing Law

These Terms are governed by the laws of the State of New York, USA, without regard to conflicts of laws provisions therein. Any disputes shall be resolved exclusively in the state or federal courts located in New York.
